Welcome to ShopCarWash. These Terms of Service ("Terms") govern your access to and use of the ShopCarWash platform, including our website and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.
Agreement to Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. For material changes or feature removals, we will provide at least 30 days advance notice where practicable. If we discontinue a paid feature you have purchased, we will provide a pro-rata refund for any unused portion of the fee. We will not be liable to you or any third party for any modification, suspension, or discontinuation of free features of the Service.
To access certain features of the Service, you must create an account. ShopCarWash uses a shared Titan Wash Tech account system. Your account may be used across other Titan Wash Tech products and services. When creating an account, you agree to:
You are responsible for safeguarding your password and any activities or actions under your account. We are not liable for any loss or damage arising from your failure to comply with this requirement.
ShopCarWash is free to browse, free to list, and charges no commissions on transactions conducted through the platform. We do not take a percentage of any sale or service fee.
We may offer optional paid features such as featured listings, additional listing photos, promoted placements, or premium profile upgrades. These are available for a flat fee and are clearly identified before purchase. Pricing for optional features is available on our website.
Payments for optional paid features are processed through Stripe, our third-party payment processor. By providing payment information, you authorize us to charge your selected payment method for applicable fees and taxes.
Fees for optional paid features are generally non-refundable, except where we discontinue a paid feature before the purchased period expires (in which case a pro-rata refund will be issued). If you believe a charge was made in error, contact us at legal@titanwashtech.com within 14 days of the charge.

You are solely responsible for the accuracy, completeness, and legality of all content you post on the Service, including equipment listings, service profiles, reviews, messages, and any other user-generated content.
When listing equipment for sale or advertising services, you must accurately represent the item or service, including its condition, availability, pricing, and any known defects or limitations. Fraudulent or intentionally misleading listings are prohibited and may result in account termination.
We reserve the right to remove or modify any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate. We are not obligated to monitor all content but may do so at our discretion.
ShopCarWash is a platform that connects buyers, sellers, and service providers. As provided under Section 230 of the Communications Decency Act (47 U.S.C. § 230), we are not the publisher or speaker of user-generated content on our platform. We are not a party to any transaction between users. We do not guarantee the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of sellers to sell or buyers to pay. Users are responsible for conducting their own due diligence.
The Service provides messaging functionality to facilitate communication between users. We do not monitor, endorse, or guarantee the accuracy of information exchanged via messages. You are solely responsible for the content of messages you send. Agreements made via messaging are between the parties involved;ShopCarWash is not a party to and bears no liability for such agreements.
Reviews and ratings must reflect genuine experiences. Fake, incentivized, or retaliatory reviews are prohibited. If you believe a review is fraudulent or violates these Terms, you may report it through the platform. We will investigate reported reviews and may remove them at our sole discretion. We do not guarantee that disputed reviews will be removed, and we are not liable for the content of user reviews.
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and applicable law.
If you believe that your copyrighted work has been copied and is accessible on the Service in a way that constitutes copyright infringement, please provide our designated DMCA agent with the following information:

We will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.
The Service and its original content, features, and functionality are owned by Titan Wash Tech LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
You retain ownership of any content, data, or materials you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely to provide and improve the Service.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.
Our Service integrates with third-party services including Firebase (Google) for authentication and data, Stripe for payment processing, and Vercel for hosting. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not make any warranty regarding the accuracy, reliability, or quality of any listings, services, or content posted by users.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TITAN WASH TECH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO ShopCarWash IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Titan Wash Tech LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@titanwashtech.com. We will attempt to resolve the dispute informally within 60 days.
Important: Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language and take place in Tennessee or, at your election, may be conducted entirely online.
The arbitrator shall have exclusive authority to resolve all disputes, including the scope and enforceability of this arbitration provision. The arbitrator's decision shall be final and binding on both parties.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits, provided the action remains in small claims court and is not transferred or appealed to a court of general jurisdiction.
You may opt out of this arbitration agreement by sending written notice to legal@titanwashtech.com within 30 days of first accepting these Terms. Your opt-out notice must include your full name, account email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Tennessee.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR IN COURT (IF YOU HAVE OPTED OUT OF ARBITRATION), WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, the entire dispute resolution section shall be null and void.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
You may delete your account at any time through your account settings or by contacting us. Upon termination:

If you disagree with material changes to these Terms, you may delete your account before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
